The Urban Development Department, Govt. of Maharashtra on December 26, 2025, issued the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships (Third Amendment) Ordinance, 2025, further to amend the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965.
The following has been stated namely: -
• In section 51A-1A, after sub-section (3), a new sub-section shall be inserted – 3A. The provision allows a person elected as both President and Councillor to hold both posts simultaneously. However, such a person is entitled to only one vote in meetings, exercisable either as President or as Councillor. In the event of a tie in voting, the President shall exercise a casting vote to decide the matter.
• In section 341B-1A, after sub-section (3), a new sub-section shall be inserted - 3A. It states that a person elected as both President and Councillor is permitted to hold both offices simultaneously. However, such a person shall exercise only one vote in meetings, either in the capacity of President or Councillor. In the event of a tie in votes, the President shall have a casting vote.
